These Terms of Service ("Terms") govern your use of the Hourvio mobile application ("App"), a product of Zabris LLC ("we," "our," or "us"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Hourvio is a shift tracking and hours calculation tool. You may use the App for personal or professional time tracking purposes. You agree not to:
To save and access your shift history, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date.
We reserve the right to suspend or terminate accounts that violate these Terms.
You retain ownership of all shift data you enter into the App. By using the App, you grant Zabris LLC a limited license to store and process that data solely to provide the App's functionality. We do not claim any ownership over your data.
You may delete your account and all associated data at any time from within the App settings.
Hourvio is a tool to help you track and calculate your hours and earnings. The calculations provided by the App are based solely on the information you enter. Zabris LLC is not responsible for errors resulting from incorrect data entry. The App is not a substitute for professional payroll, accounting, or legal advice.
All content, design, code, and materials within the App are the property of Zabris LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ZABRIS LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, ZABRIS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED $20.
You agree to defend, indemnify, and hold harmless Zabris LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any data you submit through the App.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may stop using the App and delete your account at any time.
Before filing any legal claim, you agree to contact us at support@hourvio.com and give us 30 days to resolve the issue informally. If the dispute is not resolved informally, you agree that it shall be settled by binding individual arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration against Zabris LLC.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Massachusetts.
We may update these Terms from time to time. We will notify you of significant changes by updating the date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
